By using the Services, you agree to be bound by the terms of this Privacy Policy in addition to the terms of our Terms of Use. You cannot use and must immediately cease using the Services if you don’t agree with this Privacy Policy or any other agreement that governs your use of the Services.

Magna Education gathers specific data you provide, such as information you enter and your engagement with content. Additionally, we automatically acquire data about your device and your interactions with our Services. This includes but is not limited to processes like collection, documentation, organization, storage, modification, retrieval, encryption, pseudonymization, deletion, and distribution of the data. 

Data You Provide 

The data we collect from users varies depending on their interactions with our Services. We operate on a multifaceted basis when processing the data you provide, primarily grounded in the performance of contracts and legitimate interests. 

Under the performance of contract, we ensure the fulfillment of agreements entered into with users, facilitating seamless service provisioning and ensuring the execution of obligations outlined therein. Additionally, legitimate interests serve as a foundational principle, encompassing various aspects such as identity verification, fraud prevention, and security measures to safeguard your information and maintain Platform integrity. These interests extend further to encompass communication practices vital for maintaining user engagement and satisfaction. 

Moreover, within this framework, we prioritize enhancing Platform functionality to provide you with an optimal experience. Furthermore, legal obligations play a crucial role, guiding our practices in areas such as payment facilitation, security compliance, and customer support, ensuring adherence to pertinent laws and regulations. 
This comprehensive approach ensures the responsible handling of data you provide, balancing contractual obligations, legal requirements, and your interests while upholding the highest standards of privacy and security. This includes, but is not limited to: 

  • Account Data: To access certain functionalities, such as content viewing, you’re required to register for a user account, either Educator or Student, necessitating the provision and storage of details like your email, password, and preferences. For Educator Accounts, similar information is required along with additional details as you engage with specific site features, which may include but is not limited to professional background information, identification documents, a verification photo, demographic information, interests, contact number, and contact email address. A unique identifier is assigned to each account upon creation. 
  • Learning Data: As you engage with our Platform, including all its contents, features, and functionalities, we gather information related to your interaction with courses, assignments, quizzes and tests, including your progress and completions. This data encompasses your purchase history, subscriptions, and communications with instructors and peers. Additionally, we collect submissions for coursework and other requirements necessary to fulfill educational objectives. 
  • Payment Data: During transactions, we collect essential details such as your name, billing address, and ZIP code to facilitate your order, which will be retained for ongoing subscription payment processing, as well as the option to save this data for future purchases. Payment information is provided directly to our payment processors, including details like your credit card and billing information. We receive limited data from them, such as updates on your card and its last four digits, to aid in payment processing. 
  • Communications and Support: When you reach out for assistance or to highlight an issue without regard to account status, we gather and retain your contact details, communications, and additional information you share, such as your name, email, location, and specific identifiers related to Magna Education. This collected information aids us in addressing your inquiries or concerns, aligning with our Privacy Policy directives.

In utilizing our Services, data is gathered by automated means to optimize your experience and maintain platform integrity. Our data collection practices are grounded in the performance of contracts and legitimate interests. 

Under contract performance, we collect data necessary to fulfill agreements, ensuring seamless service provision and meeting obligations. Additionally, we process data based on legitimate interests, encompassing service provisioning, customer and technical support, fraud prevention and security measures, communication, and product enhancement. 

Furthermore, our data collection aligns with legitimate interests geared toward enhancing user experience, improving products, and ensuring compliance. This approach enables us to provide a secure, personalized experience while upholding stringent privacy standards. 

When you access the Services (including browsing content), we collect certain data by automated means, including: 

  • System Data: We capture technical information about your device, including I.P. address, device and operating system type, unique identifiers, browser specifications, language settings, and other related system and Platform data. 
  • Usage Data: We collect analytics on how you interact with our Services, tracking which content you engage with, duration of page visits, navigation patterns, features utilized, search inquiries, clicks, timestamps, referring URLs, and comprehensive usage details. 

The data listed above is gathered via server logs and tracking tools, as further explained in the subsequent “Cookies and Data Collection Tools” section. This information is securely stored and linked to your user account. 

How We Collect Your Data 

We employ many standard technologies such as cookies and web beacons to collect the previously mentioned data. These mechanisms provide an option for you to opt out of data collection. 
Cookies and Data Collection Tools: We utilize cookies and small text files your browser stores to gather, retain, and disseminate data about your online activities, including interactions with Magna Education. These enable us to remember preferences like language for a smoother site experience. Additionally, we employ other data collection tools, such as web beacons in emails, to monitor their effectiveness. We deploy these tools with our service providers to automatically capture specific data about your device and usage when engaging with our services, linking it to other collected information as necessary. 

Why we use Data Collection Tools: Magna Education uses the following types of Data Collection Tools for the purposes described: 

  • Strictly Necessary: These data collection mechanisms are vital for ensuring site access, enabling core features such as login and content access, and maintaining security against unauthorized access and fraudulent activities. They are essential for the functionality of the services; disabling them may result in certain features becoming inaccessible or the site not functioning correctly. 
  • Functional: These tools retain your browser details and personal settings, enhancing functionality and tailoring content and service appearance to your preferences, such as language selection and volume levels for video playback. 
  • Performance: These tools collect and analyze how users interact with our services, including which features are most used, traffic patterns, and download origins, to enhance service quality. They enable us to experiment with different versions of Magna Education to identify preferred functionalities and content, and to monitor the effectiveness of our email communications.

However, altering these settings may impact your ability to fully use our Services, possibly leading to reduced functionality or a different user experience. We use your data to provide and improve our educational services, communicate with you, process payments, and ensure platform security. We do not use your data for purposes unrelated to delivering educational experiences and necessary platform operations.  

We leverage your data to deliver and enhance our Services, communicate with you, address issues, protect against unauthorized access, update our offerings, analyze usage, personalize ads, and maintain safety and legal compliance. This data helps us manage and personalize your experience, process payments, facilitate interactions, and develop new features. We retain your information as long as necessary for these purposes and ensure its safety and integrity.

  • Administer and provide services that facilitate use of educational content, display customized content, and facilitate communication with other users such as teachers and tutors. 
  • Process recurring subscription charges. 
  • Process your requests for and orders for content, practice exams, services, information, or features.

  • Sending you administrative information and messages, including messages from educators, notifications about service changes, and updates to our policies and user agreements 
  • Sending you information by email or text regarding course progress, practice exam results, even reminders, new services and features, promotions, newsletters. You may opt out of this communication at any time. 
  • Manage your preferences and account and personalize your experience. 
  • Address technical function, including troubleshooting and resolving of issues, securing the Service, and preventing abuse and fraud. 
  • Solicit feedback. 
  • Market products, features, and surveys. 
  • Market subscription plans to prospective customers. 
  • Enhance our understanding of you by combining the information we have with additional data obtained from third-party providers or by analyzing your data using analytics services. 
  • Identify unique users across devices. 
  • Improve our Services and develop new features, products, and services. 
  • Track and analyze traffic, trends, purchases, and usage. 
  • As we, at our sole discretion, deem it necessary to ensure the safety and integrity of our users, employees, third parties, the public, and our Services.

We do not sell your personal information to third parties. We share your data only when necessary to provide our services, with third-party service providers who are contractually prohibited from using your data for their own purposes.

  • With Your Educators: We provide instructors and teaching assistants with information about you, excluding your email address, to enhance the educational content you engage with. This includes data about your interaction with our Platform, such as course enrollment, scores, and feedback. This approach aims to improve the educational offerings for you and others while safeguarding your email privacy. 
  • With Other Students and Instructors: Depending on your settings, your shared content and profile data may be publicly viewable, including to other students in your class or live review session and instructors. If you ask a question to an instructor or teaching assistant or participate in a live review session, your information, including your name, may be visible. 
  • Service Providers: We share information with trusted third-party companies that help us operate our platform, such as ActiveCampaign, HubSpot, DataDog and Stripe among others. These providers help us process payments, prevent fraud, analyze data, and facilitate communications. Our agreements with these providers strictly prohibit them from using your data for their own purposes or targeting you with advertisements based on this data. 
  • For Legal Compliance and Security: We reserve the right to share your information with third parties under circumstances in which we, at our sole discretion, have a good faith belief that information is required for legal requests, to comply with our legal obligations, enforce our policies, prevent fraud, or protect our rights, property, and safety or those of others. This includes sharing information during legal processes, for fraud prevention, or with auditors and legal advisors to assess our compliance with this Privacy Policy. 
  • During a Change in Control: In the event of significant business changes, such as mergers, acquisitions, or asset sales, Magna Education may transfer your personal data to the involved successor organization to ensure continuity of service or during the assessment phase of such transitions. 
  • Post de-identification or Aggregation: We may disclose or use aggregated or de-identified data for any purpose. This data cannot be linked back to you personally.

You should also routinely change your password and avoid storing your password on online systems (e.g., your email account) other than trusted password managers. 

  

Your Rights 

You have the right to control your personal information. This includes accessing, correcting, or deleting your data, as well as opting out of certain types of processing and communications. 

You possess rights concerning your data, such as opting out of marketing communications, cookies, and third-party data collection. You’re able to modify or close your account directly within our services and request specific actions regarding your personal data. Should parents identify any data collected on minors without consent, we urge them to reach out for assistance at privacy@MagnaEducation.ai in removing such information.

You may elect not to share certain data with us; however, it may impede some features of the Services. 

To unsubscribe from our promotional emails, you can use the unsubscribe option within any marketing message or adjust your email preferences in your account settings. However, essential service-related communications, such as order confirmations and policy updates, will still be sent to you. 

Residents in the European Economic Area have the option to manage their cookie preferences by selecting the “Cookie settings” link found at the bottom of any webpage. 

Your browser or device settings may offer the ability to adjust cookie preferences and local data storage. For guidance on cookie management, you can visit specific online resources. Additionally, your mobile device might have options to regulate the collection and sharing of location and other types of data.

Access, Update, or Delete Your Data 

You can access and update your personal data collected, stored, or maintained by Magna Education at any time. 
You may update the data you’ve provided at any time by logging into your account and visiting your account settings. 
To terminate your account: 

  • Students and parents, visit your profile, and access subscription settings to select downgrade, pause, or cancel your account. 
  • Tutors, visit your profile, and access subscription settings to select downgrade, pause, or cancel your account. 
  • Educators, please speak with your plan administrator. 
  • It’s important to know that terminating your account doesn’t immediately remove all your data from visibility. Information you’ve shared or that has been shared by others, and content posted on third-party platforms, might still be accessible. Additionally, we hold onto your data for legitimate reasons, such as legal compliance, dispute resolution, and enforcing our terms, even after account closure, in line with our privacy practices. 

 
To request access, correct, or delete your personal data, please submit a request by emailing privacy@MagnaEducation.ai. Please allow up to thirty (30) days for a response. For your protection, we may require that the request be sent through the email address associated with your account, and we may need to verify your identity before implementing your request. Please note that we retain certain data where we have a lawful basis to do so, including for mandatory record-keeping and to complete transactions. 

Our Commitment to Student Data Privacy 

We are committed to protecting student data privacy and adhere to industry standards and best practices regarding educational data. We collect only the information necessary to provide educational services and do not use student personal information for targeted advertising or other commercial purposes unrelated to education. 

Our Policy Regarding Children 

We take children’s privacy seriously and comply with all applicable laws regarding the collection and use of information from children under 13 years of age. We do not knowingly collect information from children under 13, and we will promptly delete any such information if discovered. 

We acknowledge children’s privacy rights and urge parents to monitor their online presence. 

By accessing or using the Platform, you represent that you are either: (1) 18 years of age or older; or (2) younger than 18 years of age but at least 13 years old, and your parent or legal guardian has granted you permission to access and use the Platform. If you are under 18 years old, your parents or legal guardian must read and agree to this Privacy Policy on your behalf for you to access and use the Platform. If you are a parent or legal guardian and you grant your child permission to access and use the Platform, this Privacy Policy applies to you, and you are solely responsible for all of your child’s activities on or associated with the Platform. 

Service usage is prohibited for those under 13 years of age. Upon discovering any data collected from children under these ages, we will promptly delete it.

California
 

California residents enjoy CCPA rights, including knowing, correcting, deleting personal data, non-discrimination for exercising rights, and opting out of data sale/sharing. Magna Education adheres to CCPA, allowing for user data management and protection, including opting out via provided links. For actions under CCPA, contact Magna Education with verification for security. Information on data collection/use and sharing with third parties for marketing is available upon request, emphasizing our commitment to privacy and compliance with legal standards.

Magna Education does not sell its users’ personal information or personal data. Nonetheless, Nevada residents have the right to submit a request that we do not sell your covered personal information, which you can do by emailing privacy@MagnaEducation.ai or writing to us at Magna Education, Attn: Privacy/Legal Team, 600 Harrison Street, 3rd floor, San Francisco CA 94107. 

Australia 

Australian residents with privacy concerns can address their complaints to the Office if the Australian Information Commissioner (‘OAIC’). You may contact them via:

Users Outside the U.S. 

To deliver our Services, your data needs to be transferred and processed in the United States. By using our Services from outside the U.S., you agree to this international transfer, storage, and processing of your information.
